1. Who we are and what this Policy covers
This ZValves Privacy Policy explains how Project Snore (ZValves we, us or our) handles personal information in connection with https://zvalves.vercel.app/ (the Website), product orders, email-based accounts, newsletter subscriptions and customer support.
ZValves is a reusable, drug-free anti-snoring device using nasal dilation and micro-valve technology to support airflow. This Policy concerns information handled through the Website and business interactions. The physical product is not described on the Website as a connected sleep monitor or as recording breathing or transmitting sleep data.
This Policy is a notice, not consent to every activity described. Optional marketing, cookies and other processing require the applicable choices and legal basis. Amazon and other retailers govern their own collection under their notices. If they share order information with ZValves for fulfillment or support, this Policy applies to ZValves' handling of that information.
For product use and purchase conditions, read the ZValves Terms & Conditions.
2. Information you provide
2.1 Contact and support.
The contact form asks for your name, email address, phone number and comment. We also receive information you send by email or other support channels, including product, delivery, and fitting questions. The website asks for your email address in several places.
2.2 Accounts.
The sign-in page requests an email address and offers a one-time sign-in code rather than a password. Account-related information can include your email address, verification and session records, and orders linked to your account. Checkout discloses account creation when placing an order; it does not itself authorize marketing.
2.3 Shopping and orders.
If you place an order, the information needed includes your name, email, shipping and billing addresses, selected products, size, quantity, charges, order identifier and transaction status. This can include whether you selected the Starter Kit or a Small, Medium or Large Refill Pack and any transaction(s) history.
2.4 Payment.
Checkout presents card fields and wallet or installment choices. Depending on the option actually enabled, payment information may be handled by the selected payment provider. Payment status, transaction references and limited payment details may be shared with ZValves for order administration and fraud prevention. Do not send full card details, security codes or sign-in codes in support messages.
2.5 Subscriptions and reviews.
If you submit your email or join the newsletter, we receive your email address and subscription preferences. If you separately opt into text marketing, the relevant information includes your phone number and consent record. If you submit a review, we receive its content, chosen display name and any information needed to verify the related purchase.
3. Information from your visit and service providers
Website infrastructure can receive technical information such as IP address, browser and device type, requested pages, date and time, referring page, and error or security logs. Cookies or local storage can support sessions, cart selections and preferences. Analytics or advertising information depends on the tools actually enabled and your choices, as explained in Section 7.
Order-related providers can supply payment confirmations, delivery status and refund information. Authentication and communication providers can supply verification or message-delivery status. We use these records for the purposes described below, not as evidence of a medical diagnosis.
4. How and why information is used
4.1 Orders and accounts.
We use contact, account and order information to authenticate access, process and fulfill purchases, communicate about delivery, and handle cancellations, trial claims, refunds or replacements. Where applicable, the legal basis is performing a contract or taking steps you request before entering one.
4.2 Customer service and product quality.
We use your inquiry and relevant order details to answer questions about fit, cleaning, refills and other product issues, investigate complaints and improve support. Where applicable, this is necessary for the contract or our legitimate interests in responsive service and product quality, subject to your rights.
4.3 Security and records.
We use relevant technical and transaction records to protect accounts, investigate fraud, maintain systems, comply with tax and consumer requirements, and establish or defend legal claims. Applicable bases include legal obligations and legitimate interests in security and lawful business administration.
4.4 Marketing and measurement.
We use subscription details to send ZValves news or offers when permitted by law and your choices. Optional analytics, if enabled, helps assess Website performance and shopping journeys. Advertising tools, if enabled, require the disclosures and choices in Section 7. We rely on consent where required; any permitted legitimate-interest use remains subject to applicable objection rights.
If you do not provide information necessary for payment, delivery or authentication, we may be unable to complete that function. Optional marketing consent is not required to purchase ZValves or obtain customer support. We will explain a materially different purpose before using information for it and obtain consent where required.
5. Snoring, sleep and health-related information
A support message about ZValves may reveal symptoms, suspected condition, or a reaction to the device. Order information can also reveal an interest in snoring support. Send only the information needed to explain your issue; ordinary product support does not require a diagnosis, medical history or medical records.
If you voluntarily provide health-related details, we use them only as necessary to respond, investigate a product issue, meet a legal obligation or handle a related claim. Where special-category or sensitive-data law applies, we need an additional lawful condition, such as explicit consent or another condition specifically permitted by law.
Health details supplied for support are not permission to publish a testimonial or target health-based advertising. Access and disclosures must be limited to the people and providers who need them for the relevant purpose. We do not request access to your medical records through the Website. ZValves support is not a medical consultation.
6. Who receives information
Relevant recipients can include Website hosting and security providers; account verification and email-delivery services; commerce and payment providers; fulfillment partners and carriers; customer-support services; and analytics or marketing providers only when enabled and lawfully used. They receive information relevant to the service they perform and must be subject to appropriate contractual and legal protections.
Payment or wallet providers may process some information independently under their own privacy notices. Review the notice presented by the provider when using an available payment option.
We may disclose necessary information to professional advisers, authorities or other parties when lawfully required, to protect legal rights or safety, or in a business transfer subject to appropriate protections and notice. We may also disclose information at your specific request. A transfer does not authorize a new incompatible use without the steps required by law.
7. Cookies, local storage, analytics and advertising
Cookies are small files stored through your browser. Local storage and similar technologies can also remember information or recognize a browser. Technical server logs are separate from browser storage and can be generated when a page is requested.
7.1 Necessary functions.
Storage may be used to maintain a cart, authenticate a session, secure checkout or record privacy choices. Technologies strictly necessary for a service you request may operate without optional consent where law permits. Blocking them may prevent that service from working.
7.2 Optional analytics.
If enabled, analytics may measure page visits, referral sources, device information, errors and shopping interactions. Where legally required, we will provide information about the tracking and obtain consent before optional storage or tracking begins.
7.3 Advertising and measurement.
If advertising pixels or similar tools are enabled, they may disclose browser identifiers and activity to partners for measurement or personalized advertising. Such disclosures may count as a sale, sharing or targeted advertising under some laws even without a cash payment. Any such use is subject to the disclosures, consent and opt-out choices required by applicable law.
7.4 Your controls.
You can use browser settings to block or delete cookies and local storage. Where available, use the Website's cookie preference control to change optional categories. Withdrawing consent does not affect processing already lawfully carried out. Disabling one browser's cookies may not change another browser's settings.
Where applicable law requires recognition of an opt-out preference signal, such as Global Privacy Control, ZValves must give that signal the required effect. You can also request privacy assistance through the Website contact form.
8. Email and text choices
Joining the newsletter requests promotional email about ZValves. You can unsubscribe through a marketing email or contact ZValves. We may retain the minimum information needed to honor an opt-out. Necessary order, account, delivery, recall or support messages may still be sent.
Providing a phone number or sending a support inquiry does not, by itself, consent to promotional texts or emails. If ZValves offers text marketing, a separate lawful opt-in must explain the program and how to stop it. Use the opt-out instruction supplied with those messages or contact ZValves. Marketing choices do not affect your eligibility to purchase or obtain a remedy.
9. Retention and deletion
We retain personal information only for as long as reasonably needed for the stated purpose, applicable recordkeeping or regulatory duties, and resolution of claims. Order, payment and refund records are kept for the applicable tax, accounting ,regulatory, and consumer-law periods. Account data is kept while needed to provide the account and fulfill remaining obligations.
Support records are retained for the inquiry and any reasonably related product or legal issue; unnecessary health details should be removed sooner. Marketing data is retained while the subscription is active, with a limited suppression record after opt-out. Technical logs are kept for operational and security needs. Browser storage may expire at the end of a session or persist for a period appropriate to its purpose.
When information is no longer needed, it is deleted or made non-identifiable, subject to lawful holds and scheduled backup deletion. A deletion request may not remove records that must lawfully be retained; we will explain relevant exceptions.
10. Security
We use reasonable safeguards appropriate to the information and processing, including access restrictions and suitable technical and organizational protections. No Website, transmission method or storage system is completely secure. Protect access to your email and one-time codes and notify ZValves of suspected misuse. We will address and report a personal information breach as required by applicable law.
11. Your privacy rights
Depending on your location and the laws that apply, you may request access to or a copy of your information; correction; deletion; portability; restriction of processing; withdrawal of consent; or objection to processing based on legitimate interests. You may also have rights to opt out of sale, sharing or targeted advertising, limit certain sensitive-data uses, or obtain information about recipients and purposes.
Send requests through the Website contact form at https://zvalves.vercel.app/contact. Identify the request and the email associated with your interaction. We may request proportionate information to verify identity or an authorized agent's authority. Do not send identity documents unless we explain why they are needed and provide a suitable method.
We respond within applicable legal deadlines and explain any permitted extension, refusal or fee. Where an appeal right applies, you can appeal a refusal through the same contact form and mark the message as an appeal. We will not unlawfully discriminate against you for exercising your rights.
You may complain to your competent privacy regulator without first contacting ZValves. Where EU or UK law applies, you may object to direct marketing. US state rights depend on the applicable law's scope and exceptions.
12. International processing and children
Providers may process information outside your country. Restricted international transfers require a lawful mechanism, such as an adequacy decision or approved contractual safeguards with necessary supplementary measures. Contact ZValves through the Website contact form for details or copies of applicable safeguards, subject to lawful redactions.
Shopping and account services are directed to adults able to contract. We do not knowingly solicit children's information. Contact us if a child has supplied information so we can assess and delete it or take other legally required steps. This does not establish pediatric product suitability.
13. Third-party sites and Policy changes
Third-party services have their own privacy notices. We remain responsible for processing under our control. We may update this Policy and its Last Updated date, with additional notice or consent where required. An update does not retroactively authorize processing without a lawful basis.
